1. Introduction / Agreement to Terms

Welcome to Blue Ridge Estate & Concierge. These Terms of Service govern your use of our website and any home watch or concierge services we provide. By accessing our website, requesting a proposal, or engaging us to provide Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with these Terms, you should not use our website or engage our Services.

2. Services

Blue Ridge Estate & Concierge provides professional home watch and concierge services to homeowners in Asheville, North Carolina and surrounding areas. Our goal is to offer reliable, local oversight and support so your property is cared for when you are not there, and to simplify your time at home when you are.

Typical Services may include, but are not limited to:

• Scheduled visual inspections of the interior and exterior of your home
• Monitoring for obvious signs of damage, water intrusion, pest activity, or mechanical issues
• Coordinating access for approved vendors and service providers
• Overseeing deliveries, mail collection, or package placement as agreed
• Light concierge assistance, such as pre-arrival preparations, basic stocking, or coordinating local services as requested

Our Services are focused on observation, reporting, and coordination. We are not an emergency response service, security company, general contractor, or licensed tradesperson. We do not provide medical, security, or law enforcement services, and we do not perform construction, major repairs, or specialized trade work. When maintenance or repairs are needed, we can help coordinate with qualified third-party vendors chosen by you, or recommended by us and approved by you.

The specific scope, frequency, and pricing of Services for your property will be described in a separate written service agreement executed during onboarding. If there is any conflict between these Terms and your signed service agreement, the signed service agreement will control with respect to the Services provided to you.

3. Service Area

We primarily serve homeowners in Asheville, North Carolina and surrounding regions in Western North Carolina. Service availability may be limited by distance, road access, and the time required to reasonably reach your property.

We reserve the right to accept or decline service requests based on location, safety considerations, access conditions, and scheduling capacity. Any service area commitments or travel fees applicable to your property will be outlined in your individual service agreement.

4. Client Responsibilities

To provide reliable and effective care for your property, we rely on accurate information and cooperation from you as the homeowner (“Client”). By engaging our Services, you agree to:

• Provide safe, lawful access to the property, including keys, codes, gate information, and any required access instructions.
• Inform us of any known issues, vulnerabilities, or special features of the property (for example: prior leaks, known pest problems, alarm system quirks, or areas that require extra attention).
• Maintain current contact information and provide at least one reliable emergency contact who is authorized to make decisions if you cannot be reached.
• Keep all utilities necessary for agreed-upon Services in good working order (for example: power, water, and internet if needed for monitoring systems).
• Clearly communicate any changes to your schedule, occupancy, or property use that may affect Services.
• Review our inspection reports and promptly address any recommended repairs or safety concerns with appropriate professionals.

You are responsible for arranging and approving all repair or improvement work at the property, whether you select vendors yourself or request our assistance in coordinating third-party providers. You remain the party to any contracts with third-party vendors, and you are responsible for payment to them.

5. Limitation of Liability

We take our responsibility to care for your home seriously and strive to provide thorough, attentive service. However, there are practical limits to what home watch and concierge services can reasonably prevent or control. By engaging our Services, you acknowledge and agree to the following limitations:

• We are not responsible for pre-existing conditions at the property, including prior damage, defects, or code issues that existed before our Services began.
• We are not liable for damage or loss arising from events outside of our reasonable control, including but not limited to severe weather, acts of nature, power outages, vandalism, theft, or other criminal activity.
• Our inspections are visual and non-invasive. We do not move large furniture, open walls, or perform technical testing. Some issues may not be visible or detectable at the time of our visits, and we cannot guarantee the prevention of all damage or loss.
• When we coordinate work with third-party vendors or service providers, those providers remain independent contractors. We are not responsible for their acts, omissions, workmanship, delays, or any damages caused by them. Any warranties or guarantees are provided directly by the third party, not by us.

To the fullest extent permitted by applicable law, our total liability to you for any claims arising out of or related to the Services will be limited to the total amount of fees you have paid to us for Services during the twelve (12) months immediately preceding the event giving rise to the claim. In no event will we be liable for indirect, incidental, special, or consequential damages, including loss of use or loss of value, even if we have been advised of the possibility of such damages.

6. Payment & Cancellation

Details regarding pricing, billing frequency, accepted payment methods, cancellation rights, rescheduling, and any minimum service commitments are set out in the written service agreement you will review and sign at onboarding.

In the event of any inconsistency between this section and your signed service agreement, the specific terms in your service agreement will govern.

7. Privacy

We understand that inviting a service provider into your home requires trust. We treat your personal information, property details, and access credentials with care and discretion, and we do not sell your personal information to third parties.

Our collection, use, and protection of your information is described in more detail in our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy carefully and contact us with any questions.

8. Changes to These Terms

We may update or revise these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. When we make changes, we will update the “Last updated” date at the top of this page. The updated Terms will be effective when posted on our website unless otherwise stated.

Your continued use of our website or Services after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you should stop using our website and Services.
